Hotel & Reservation Terms and Conditions

MRK Ivey’s Hotel, LLC dba The Ivey’s Hotel

1. Application and booking terms

These terms apply to reservations made through the Hotel’s website or booking platform and the associated stay. The accepted confirmation and displayed rate conditions identify dates, room type, occupancy, price, payment, and cancellation rules. An accepted package, group agreement, or third-party booking condition controls only the subjects it expressly addresses. Contact us promptly about a confirmation error.

2. Rates, taxes, and optional charges

Rates are in U.S. dollars. The booking flow will display the total, mandatory charges, applicable taxes, and selected optional services before purchase. Rates for future bookings may change; requested changes to a confirmed stay may result in a new rate. Government-imposed taxes may change as required by law. Optional purchases, food and beverage charges, and any applicable automatic service charge will be disclosed before purchase.

3. Guarantee, payment, and cancellation

A valid payment card is required to guarantee a standard flexible-rate reservation. The standard flexible rate is not automatically prepaid 72 hours before arrival. The confirmed rate plan specifies when any deposit or payment is due; advance-purchase, package, group, and other special rates may differ.

Unless your accepted confirmation says otherwise, the standard flexible rate may be canceled without charge if cancellation is received at least 72 hours before the scheduled 4:00 p.m. arrival time, Charlotte local time. A cancellation after the deadline or no-show incurs one night’s room and applicable tax. A payment already collected toward that charge will not be charged again. Cancel through the booking portal or by calling 704-998-0111 and retain the confirmation.

If a required payment method is invalid, we may seek an updated method. We may release a reservation if the required guarantee cannot be secured after reasonable efforts to contact you, subject to the rate conditions and applicable law. An unprocessed card does not itself mean you requested cancellation.

Approved refunds are processed promptly to the original payment method in accordance with the applicable policy and law. Your bank or card issuer controls when a credit becomes available.

4. Changes, no-shows, and early departure

Changes are subject to availability and may alter the rate. Moving an arrival date after the cancellation deadline does not automatically remove an applicable charge. If you expect to arrive after midnight, please notify us. A no-show may result in release of remaining nights, subject to the accepted rate or group conditions.

Please confirm your departure date at check-in and notify us as soon as plans change. Any early-departure charge must be the single, clearly disclosed rule in your confirmation or applicable group agreement; no discretionary $75-or-full-night formula is included here pending an operating decision.

5. Check-in, checkout, and occupancy

Check-in begins at 4:00 p.m.; checkout is by 11:00 a.m. The registering guest must be at least 21 and provide government-issued identification and an accepted payment method. Occupancy is limited to the room’s stated capacity and safety requirements. Children under 17 must be supervised by an adult. Early check-in and late checkout require hotel approval and availability; any applicable late-checkout price will be quoted and accepted before the extension. A charge alone does not authorize continued occupancy.

6. Incidental authorization and payment

At check-in, the Hotel places an incidental authorization of $250 per reserved night, in addition to amounts required for the room and tax. This is a hold rather than a completed charge and may reduce available credit or debit-card funds. Additional authorization may be requested if the stay is extended or charges exceed the secured amount. Unused authorization is released after settlement; the card issuer determines when funds become available.

By providing an authorized payment method, you authorize charges due under your accepted rate and stay, including room and tax, minibar and other authorized purchases, disclosed cancellation or no-show charges, approved late checkout, and reasonable documented damage or extraordinary cleaning. We will provide an itemized account and an explanation of post-departure charges. Billing: accounting@theiveyshotel.com.

7. Pets and service animals

Pets must be registered and approved for a designated pet-permitted room. The agreed revised pet fee is $150 plus applicable tax for a stay of one through four nights, plus $75 plus applicable tax for each night beginning with night five. Any separate pet-count or weight limit will be posted only after management confirms it. Owners are responsible for control, disturbances, actual damage, and extraordinary cleaning beyond the ordinary pet fee, without duplicate recovery.

Service animals are accommodated as required by law and are not subject to pet fees or pet-room and weight restrictions. Ordinary cleaning does not incur an additional service-animal fee. Actual damage may be charged on the same basis as damage caused by other guests.

8. Smoking, safety, and conduct

The property is nonsmoking except any clearly designated outdoor area. Smoking and vaping, including cannabis products, are prohibited in rooms and on balconies. If a violation requires remediation, a minimum $350 cleaning charge may apply; documented additional remediation costs may be charged to the extent permitted by law. Candles, incense, open flames, and tampering with life-safety equipment are prohibited.

No parties or unauthorized gatherings are permitted in guest rooms. Quiet hours are 11:00 p.m. to 6:00 a.m. Guests and visitors must follow reasonable safety directions and refrain from excessive noise, threats, harassment, unlawful conduct, or property damage. The Hotel may require a visitor to leave or end a stay for serious or repeated violations as permitted by law; charges and refunds follow accepted conditions and applicable law.

9. Amenities, events, and parking

Amenities, dining hours, and event spaces may change. If a service expressly included in your reservation cannot be provided, contact us so we can address the issue under your booking terms and applicable law. We do not promise proactive notice of every operational change or private event.

Valet service is operated and billed by an independent parking company. Price and service terms will be disclosed before use. There is no on-property self-parking. Responsibility for a loss is determined by the facts, applicable agreements, and law.

10. Accessibility, property, and lost items

Guests may request accessible features or accommodations at guestservices@theiveyshotel.com. We address accessible reservations and service animals in accordance with applicable law; advance contact can help us prepare but is not a blanket condition of service.

In-room safes are provided. Please report missing or damaged property promptly. The Hotel’s responsibility is governed by applicable law; these terms do not state a blanket $1,000 limit. Lost items are ordinarily retained for 30 days, subject to applicable law and the Hotel’s written handling procedure. Guests are responsible for arranging and paying for return shipping when applicable.

11. Damage, disruptions, and reservation issues

Guests are responsible, to the extent permitted by law, for reasonable documented repair, replacement, and extraordinary cleaning attributable to their conduct or that of occupants or visitors for whom they are legally responsible. Normal wear is not chargeable. We do not recover twice for the same loss.

If circumstances outside reasonable control prevent the Hotel from furnishing a confirmed stay, we will contact the guest and address unused payments and available alternatives under the accepted conditions and applicable law. If we cannot honor a reservation for another reason, we will contact the guest promptly and work toward an appropriate resolution. These terms do not promise a fixed relocation payment.

Please raise service or billing concerns during the stay when possible, or contact guestservices@theiveyshotel.com after departure. We will respond as promptly as circumstances permit; no fixed contractual response time is promised.

12. Other terms

Third-party bookings may have provider-specific payment and cancellation procedures. An exception to a policy does not automatically waive it for another stay. If a provision is unenforceable, the remainder continues to the extent allowed by law. The version accepted when you book governs that reservation unless you later agree to a change or law requires one. North Carolina law applies subject to mandatory protections. Website use and personal-information practices are addressed in the separate Website Terms of Use and Privacy Policy.

The Hotel shall have the right in a proper case to obtain temporary restraining orders, temporary or preliminary injunctive relief and/or declaratory relief (other than declarations with respect to the amount of money damages) from a court of competent jurisdiction.

The arbitration proceedings shall be heard by one independent arbitrator who shall be an attorney or retired judge. The arbitration shall be held under then-existing Commercial Arbitration Rules of the AAA in the city where the Hotel is located. All matters within the scope of the Federal Arbitration Act (9 U.S.C. 1, et seq.) will be governed by it and not by any state arbitration law. You and the Hotel waive any right to a jury trial for such disputes. The rules in arbitration are different from the rules that apply in court. There is no judge or jury, and review is limited, but an arbitrator can award the same damages and relief, and must honor the same limitations stated in the Terms, as a court would.

In reaching his or her decision, the arbitrator shall follow these Terms and Materials, shall be bound to apply the applicable law and shall not rule inconsistently with the applicable law. The arbitration shall be conducted on an individual basis, and not as a consolidated, common, representative, group or class. The arbitrator shall include in his or her award any relief he or she deems proper in terms of money damages (with interest on unpaid amounts from the date due at the maximum rate allowed by law), and attorneys’ fees and costs. The award of the arbitrator shall be conclusive and binding upon all parties hereto and judgment upon the award may be entered in any court of competent jurisdiction. Other than as may be required by law, the entire arbitration proceedings (including, but not limited to, any rulings, decisions or orders of the arbitrator), shall remain confidential and not be disclosed to anyone other than the parties to these Terms.

LIMITATIONS PERIOD. Any and all claims and actions arising out of or relating to these Terms, the Site, or Materials shall be commenced within one (1) year from the occurrence of the facts giving rise to such claim or action, or such claim or action shall be barred. This limitation period does not apply to residents of New Jersey.

CLASS ACTION Waiver. You agree that you will not file a class action against the Hotel, or participate in a class action against the Hotel. You agree that you will not file or seek a class arbitration, or participate in a class arbitration, against the Hotel.

MISCELLANEOUS PROVISIONS. These Terms constitute the entire agreement of the parties with respect to the subject matter hereof and supersede all prior oral and written agreements. No failure or delay on the part of the Hotel in exercising any right or remedy hereunder or enforcing the terms and conditions of these Terms will operate as a waiver thereof. If any part or provision of these Terms is found to be invalid, unenforceable or void, then the remaining portion shall remain in full force and effect. Headings are for convenience only and not for use in interpretation of these Terms.
